Terms of Sale

1. General Information

This document regulates the general conditions of sale and contracting applicable to purchases made through the website www.latermoteca.com (hereinafter, the Website), owned by BOTIJALIA SL, with CIF B22721823 and address at C/ de Espronceda, 34, 1 interior, 28003 Madrid (Spain).

The business activity is carried out under the brand name La Termoteca, which is currently in the process of being registered with the Spanish Patent and Trademark Office.

2. Scope of application

These conditions regulate the contractual relationship between BOTIJALIA SL and the users of the Website, both individual consumers (B2C) and professionals or companies (B2B).

In the case of professional clients, the provisions on consumer protection will not apply, and the relationship will be governed by the Commercial Code and other commercial regulations.

3. Purchase process

To place an order, the user must select the desired products, add them to the cart and complete the purchase process, providing the requested data and making the payment through one of the means enabled in Shopify (card, PayPal, etc.).

The order confirmation sent by email constitutes acceptance by BOTIJALIA SL and the formalization of the sales contract.

4. Prices and taxes

All prices are shown in euros (€) and include applicable VAT according to current legislation in Spain.

Prices do not include shipping costs, which will be borne by the buyer and will be shown in a detailed breakdown before confirming the order.

5. Shipping and Delivery

Orders are shipped via partner courier and transport companies within Spain and the European Union.

Shipping costs, delivery times and available areas will be indicated during the purchase process.

Delivery times may vary depending on the destination and whether the product requires customization. BOTIJALIA SL will not be responsible for delays caused by external factors (strikes, weather conditions, carrier issues, etc.).

If the package arrives visibly damaged, the customer must note this on the delivery slip and report it by email to info@latermoteca.com within a maximum of 48 hours.

6. Payment methods

The Website uses payment gateways enabled by Shopify (Shopify Payments, Stripe, PayPal, etc.), guaranteeing the security and confidentiality of the data.

The charge will be processed upon order confirmation. BOTIJALIA SL does not store customer bank details.

6 bis. Billing

BOTIJALIA SL will issue an invoice only when the customer expressly requests it or when the transaction requires it by legal provision (for example, sales to companies or professionals).

The customer can request the invoice by sending an email to info@latermoteca.com , indicating their order number and their tax information (name or company name, NIF/CIF and address).

Invoices will be issued in electronic format (PDF) and sent to the email address provided by the customer.

7. Right of withdrawal (B2C only)

In accordance with Articles 102 et seq. of Royal Legislative Decree 1/2007, consumers have a period of 14 calendar days from receipt of the order to withdraw from the purchase, without needing to provide justification.

The right of withdrawal will not apply in the following cases:

●      Customized products or products made according to the customer's specifications (art. 103.c TRLGDCU).

●      Products that, for hygiene reasons, cannot be returned once opened.

To exercise the right of withdrawal, the customer must notify info@latermoteca.com in writing, indicating their order number. Shipping and return costs will be borne by the buyer.

8. Returns and exchanges

Returns will only be accepted if the product has a manufacturing defect or an error attributable to BOTIJALIA SL

In such a case, the customer must notify within a maximum period of 14 calendar days from receipt of the order, attaching photographs of the defect and the order number.

After verification, the product will be replaced or, failing that, refunded.

Returns of personalized products will not be accepted, except in cases of manufacturing error or defect.

9. Customized products

Customized products are manufactured according to the customer's instructions (text, name, logo or design).

By submitting their customization, the customer declares that they own the rights to the content provided and guarantees that it does not infringe the rights of third parties or contain offensive or illegal expressions.

BOTIJALIA SL may reject engravings or customizations that do not comply with these conditions.

Personalized products are not eligible for exchange or return, except in the case of error or defect attributable to BOTIJALIA SL.

Since the engravings are done manually with laser technology in our workshop, each piece is unique and may present slight variations in tone, position or intensity of the engraving, inherent to the artisanal process.

These small differences are not considered manufacturing defects, but rather characteristics inherent to custom and manual work.

10. Warranty and exclusions

The products sold by La Termoteca have the legal guarantee of conformity established in current regulations and, additionally, the commercial guarantee offered by each brand or manufacturer, as the case may be.

The warranty covers exclusively manufacturing or conformity defects, and does not include:

●      Damage caused by blows, falls, accidents or improper handling.

●      Natural wear and tear resulting from normal use.

●      Damage caused by use contrary to the manufacturer's instructions or by improper cleaning.

●      Alterations, engravings or manipulations made by third parties after delivery.

In the case of B2B customers (companies or professionals), the applicable warranty will be that provided by the original manufacturer or supplier, without prejudice to the corresponding minimum legal guarantees.

To process a warranty claim, the customer must contact info@latermoteca.com indicating the order number and a description of the defect along with photos of the product.

11. Responsibility

BOTIJALIA SL will not be liable for indirect damages, lost profits or losses resulting from misuse of the products.

The images shown on the Website are illustrative and may present slight variations from the final product.

13. Applicable law and jurisdiction

This document is governed by Spanish law.

In case of dispute, the parties will submit to the competent Courts and Tribunals in accordance with the applicable consumer regulations, corresponding, in the case of consumers, to those of the user's domicile.

For business clients (B2B), the parties expressly submit to the Courts and Tribunals of Madrid (Spain), expressly waiving any other jurisdiction that may correspond to them.
